QwestLab Participant Media & AI Data Agreement

By participating in a QwestLab data collection project, I knowingly and voluntarily agree to the recording, collection, processing and use of the video, audio and other data I create or submit in connection with the project.

What may be recorded

I understand that project recordings may include my image, face, body, hands, movements, gestures, actions, voice, speech, sounds, surroundings, interactions with objects, equipment and environments, as well as technical information associated with the recording.

Recordings capture sound as well as picture. A camera pointed down at my hands still records the whole room, including anyone speaking outside the frame.

Purpose

I understand that the recordings and associated data may be used for commercial artificial intelligence, machine learning and robotics purposes, including creating and licensing datasets; training, fine-tuning, testing, evaluating and improving AI and machine-learning systems; computer vision; speech and audio systems; multimodal models; robotics and embodied AI; model evaluation; research; annotation; quality assurance; and development of related technologies, products and services.

Rights granted

To the fullest extent permitted by applicable law, I assign to QwestLab all right, title and interest that I own or control in the recordings, submissions and other project materials I create for QwestLab.

To the extent any such rights cannot legally be assigned, I grant QwestLab and its affiliates, customers, licensees, sublicensees, service providers, successors and assigns a worldwide, perpetual, irrevocable, transferable, sublicensable, fully paid and royalty-free license to use, reproduce, store, copy, edit, annotate, label, translate, modify, adapt, combine, transform, distribute, display, analyze, commercialize, license and otherwise use those materials for the purposes described in this Agreement.

This includes the right to create datasets, annotations, metadata, features, embeddings, derived data and other materials from the recordings and to permit QwestLab customers and licensees to use those materials in connection with AI, machine-learning and robotics systems.

My image, voice and likeness

I authorize QwestLab and its customers and licensees to use my appearance, image, likeness, movements, gestures, voice and speech as captured in the recordings for the purposes described above, subject to applicable privacy and data-protection law.

I understand that the recordings may be edited, segmented, annotated, combined with other data, transformed or used as part of larger datasets and that I may not be identifiable as the original contributor in resulting datasets, systems or products.

QwestLab does not create voiceprints and does not clone voices under this Agreement. Nothing recorded here is used to build a synthetic copy of my voice, or to identify me by the sound of it. If QwestLab wants to do either, it will ask separately and I am free to refuse without losing access to work.

Commercial use

I understand that QwestLab may commercially license or otherwise provide the recordings or derived datasets to customers and partners developing AI, machine-learning, robotics or related technologies.

Unless a specific project states otherwise, I am not entitled to royalties, residual payments or other compensation arising from later use or commercialization of the recordings beyond the compensation offered for my participation in the applicable QwestLab project.

Other people appearing in recordings

I understand that I must not intentionally record an identifiable person unless that individual has been authorized to participate in the applicable project or has completed the consent/release process required by QwestLab.

A person is recorded whether they are seen or heard. Someone speaking off camera is recorded even though the picture contains only my hands. This is the rule broken most often by accident.

Before recording I will check that nobody else is speaking within earshot, that no phone or video call is audible, and that any television, radio or music with talking on it is switched off.

I represent and warrant that I will follow the project's rules concerning third-party appearances and that I will not knowingly submit recordings containing identifiable individuals for whom the required authorization has not been obtained.

If an unauthorized individual is captured unintentionally, I will follow QwestLab instructions regarding stopping the recording, reporting the incident, re-recording the task, or allowing the footage to be excluded or appropriately redacted.

In the Philippines this is not only a project rule. Recording a private communication without the authorization of every party to it is a criminal offence under the Anti-Wiretapping Act (Republic Act No. 4200), punishable by imprisonment. This section protects me before it protects QwestLab.

The current project rules are stricter than this Agreement. Today no other person may appear in or be heard in any recording, and no one under 18 may appear or be heard under any circumstances, regardless of any release. The app states the rules that apply to each task, and those rules govern.

Locations and property

I represent that I have permission to perform the assigned recording activity in the location where I record and will comply with any project-specific restrictions regarding confidential information, private property, customers, guests, computer screens, documents, license plates, personal information or restricted areas.

No confidential or third-party material

I will not intentionally capture confidential business information, copyrighted media, customer information, private communications, financial information, health information or other protected material unless the project specifically authorizes its collection and the necessary permissions have been obtained.

Privacy and data processing

I understand that recordings may constitute personal data and will be processed as described in the QwestLab Privacy Notice and any project-specific notice, including information concerning the identity of the data controller, recipients or categories of recipients, international transfers where applicable, retention, security measures and my applicable data-subject rights.

My name, email address and mobile number are stored to administer my participation. They are not written into any video file, filename or metadata shared outside QwestLab. Within any dataset shared with a customer I am identified by a random participant reference, not by my name.

Nothing in this Agreement limits any privacy or data-protection right that cannot legally be waived.

Withdrawal

I can withdraw at any time through the app or by messaging QwestLab. Withdrawing stops any further use of material I have not yet submitted. Recordings already accepted before I withdraw may still be used as described above, and I keep what I have already earned for them.

Payment

I am paid per accepted recording, one at a time — not per set. Each recording is reviewed on its own and earns the amount shown on that task in the app once accepted. Nothing is held back or made conditional on finishing any other task. A recording that is turned down earns nothing; one returned for a re-record earns in the normal way once accepted.

Payouts are not switched on yet. Earnings are recorded in the wallet in the app and stay there until payouts open. QwestLab will say when that happens and what is needed to receive the money. Amounts are held in US dollars.

Age and authority

I confirm that I am at least 18 years old and have the legal capacity to enter into this Agreement.

I confirm that I have read and understood this Agreement, the QwestLab Privacy Notice and the applicable project instructions, and voluntarily agree to participate.

Record of my acceptance

When I accept, QwestLab records my typed name, the version of this Agreement, a timestamp, and technical details of the device and browser I used. That record cannot be edited or deleted afterwards.
